Welbutryn: Legal Implications

This will seem kind of strange to you but I really need some information.

My wife of twelve years has been the primary income provider in our home. I had been the primary care-giver for our two 6 year old twins. Her GP has been prescribing Welbutryn to her for over a year now as a smoking supressant.

She has now moved in with the man that she was having an affair with and has perjured herself by creating a restraining order against me (I saved a message she left on my answering machine in which she admitted this, however, the court is not interested). She has done this so that instead of appearing before family court, we have appeared before domestic violence court. She knew that once we appeared there, the court would already be in her favor, which it has. As a result of this, she now has more time with our children than she ever has, more than she has available and I have less. Our children have expressed to myself and her that they would rather be with me than be left babysitted by the tv, computer games and her boyfriend but that is of little importance to the legal system that is of course, "serving the best interests of the children".

This is the problem: this woman is completely detatched from reality. She kept bringing her current boyfriend to my house after I asked her not too and she tells me to "get over it". You can't imagine what it's like to look out my window and see this man playing with my own children. Concerning the restraining order, she told me "not to take this personally". She continually lies and I don't think that even she is aware of it. There's more but I think I've made my point.

I realize that I had been deceived and that this woman was not the woman that I thought she was, but this is far too drastic and I am not that much a fool. I honestly believe that Welbutryn has contributed to this behavior.

My question is this: is it legal to have a GP, not a psychiatrist prescribe an antidepressant for such an extended period of time? It has definitely altered her mind and from my perspective, for the worse.

If you know of the legal implications of this, I would appreciate a reply.

By the way, we live in California.
