I have clinical depression, and there are days that my illness prevent me from getting out of bed, thereby preventing me from going to work. If I call in sick due to my depression, are my actions covered under ADA?

Nole, I don't know. I would call your state office when you're up to it, unless anyone else knows Florida laws.
sorry you are doing so poorly right now.

Nole, I went/am going through something very similar with my job. You are protected under the Family and Medical Leave Act (FMLA) but only if you file for it. There is paperwork that your HR office will need you and your doctor to fill out. You are not automatically protected unless you file and are approved for FMLA. It was a tough decision for me for awhile because I didn't want to go through the whole process and didn't want everyone at work to know that I was bipolar, etc. When it was just a couple days and I had sick leave to take, I didn't worry much about it but when it became more frequent I actually had to go ahead and go through the process to file for protection under FMLA. FMLA will then determine how frequent you can be absent from work, etc.
This is the end of the thread.
